  • SECTION 51 – OVER VOTING –

(1) No voter shall vote for more than one candidate or record more than one vote in favour of any candidate at any one election.
(2) Where the number of votes cast at an election in any polling unit exceeds the number of accredited voters in that polling unit, the Presiding officer shall cancel the result of the election in that polling unit.

(3) Where the result of an election is cancelled in accordance with subsection (2), there shall be no return for the election until another poll has taken place in the affected polling unit.

(4) Notwithstanding the provisions of subsections (2) and (3) the Commission may, if satisfied that the result of the election will not substantially be affected by voting in
the area where the election is cancelled, direct that a return of the election be made.

SECTION 65- DECISION OF RETURNING OFFICER ON BALLOT PAPERS-
 

(1) The decision of the returning officer shall be final on any question arising from or relating to –

(a) unmarked ballot paper;

(b) rejected ballot paper; and

(c) declaration of scores of candidates and the return of a candidate:

Provided that the Commission shall have the power within seven days to review the
declaration and return where the Commission determines that the said declaration and return was not made voluntarily or was made contrary to the provisions of the law, regulations and guidelines, and manual for the election.

(2) A decision of the returning officer under subsection (1) may be reviewed by an election tribunal or court of competent jurisdiction in an election petition proceedings under this Act.
THE LAW IS NOT A ONE WAY TRAFFIC NEITHER IS IT TWO OR THREE. JUSRIPRUDENCE IS SCIENCE OF LAW AND IN IT THEIR ARE SCHOOLS OF TAUGHT. DON’T EXPECT THE LAW TO BE AN EXPRESS AND NOTE THAT, THE COURT IS NOT FATHER CHRISTMAS, YOU ARE ONLY GIVEN WHAT YOU ASK NOTHING ELSE. 

A lot asked the question, does INEC (Returning Officer) have the power to review and return the election made? Yes they do by perusing from the above sections made available to your glaring. 
I know most don’t understand this but take a pill and sit back, i will school you in the line of my chosen school of taught. The battle seems already won according to the opposition but it will be to bewilderment of many not to have understood the legal intricacies and at the end, they will turn to the judge or their legal counsel who chose probono to garner fame in such mouth watering brief while riding on excruciating pains of the employer.

Crowd mentality is such a sham and daft approach to matters of legal juxtaposition. 
The INEC responded to the alarm raised by labour party and did justice by reviewing it. All the polling unit affected and ochestrated by whom God knows, was dealt with accordingly as provided above but due to mischief makers, this is the last card to recuperate their losses while deceiving the gullibles that Nkanu East should be cancelled, the law never made mention of {otu aka ruta manu ozuoro oha} It only talked about the affected areas not all areas; while the Golliat and Pharoes had gone back to base after learning the truth of the scenario, confused and handicapped hurriedly left disappointed to the marauding facts of a piece of evidence.

I asked again, why the sudden interest in my poor Enugu State? I remembered, oil was recently discovered. I also remembered gypsum was also discovered and percentage dealers have come clustering but God had special purpose for sons of men. 
The youth of Enugu State, If you like mortgage your future in the hands of people interested in negotiating new godfathers while we fight to emancipate ourselves from infested cannon, don’t be deceived by political musketeers, our future is the exchange of their teaming support.
